Canadian DJ Contract: Ontario Deposit & Cancellation Rules

Canadian DJ contract rules on deposits and cancellations in Ontario: Consumer Protection Act sets refund, written terms, and notice rules for future services.

What to take away

  • Ontario's Consumer Protection Act governs most Canadian DJ contracts signed with consumers in the province, including deposit and cancellation terms.
  • A deposit is not automatically non-refundable. The contract must state under what conditions the client gets money back.
  • In Ontario, if a supplier accepts payment for a future service and misses the agreed date or an implied 30-day deadline, the consumer can cancel and get a full refund.
  • British Columbia's Business Practices and Consumer Protection Act and Alberta's Consumer Protection Act require written future service contracts with specific disclosures.
  • Skipping the required written terms exposes a DJ to a one-year cancellation window for the client.

Who has jurisdiction over an Ontario DJ contract

Provincial consumer protection laws set the rules for consumer agreements, not federal law. For a Canadian DJ contract signed with a consumer in Ontario, the Consumer Protection Act, 2002 and Ontario Regulation 17/05 (General) apply. Consumer Protection Ontario enforces that act. For an event in Toronto, Ottawa or Mississauga, Ontario's rules apply even if the DJ's business address is in another province. For a client in British Columbia, the Business Practices and Consumer Protection Act applies. Alberta has its Consumer Protection Act. Deposit rules are separate from music licensing obligations. See SOCAN Fees for Mobile DJs for the copyright side.

What a DJ may and may not do with deposits

A deposit is an advance payment, not a free pass to keep money after a cancellation. Under Ontario's Consumer Protection Act, a supplier who accepts payment for future performance must deliver the service within 30 days of the date stated in the contract or a date implied by the agreement. If the supplier misses that window, the consumer may cancel and get a full refund. The DJ may keep a deposit only if the contract sets out a clear, fair cancellation fee and the cancellation is the client's choice, not a failure by the DJ. A clause that says "all deposits are non-refundable" without a cancellation right can be challenged. In practice, contractual terms that take away a consumer's statutory cancellation right are void under section 7 of the act.

In Ontario, a missing cancellation clause can turn any deposit into a full refund obligation for the next 12 months. A deposit clause is only one part of a full agreement. See DJ Contract Clauses for what else belongs.

Contract labelling requirements

In Ontario, a future performance agreement must be in writing and must include certain information. The legal term is not "labelling" but the required contents act as a label on the deal. A compliant contract label carries the total price, the deposit amount, the date and location of the performance, and the consumer's cancellation and refund rights. It also must state the name and address of the supplier and the date the contract is made. If any of these items is missing, the consumer has up to one year to cancel the agreement. This is a strict rule. A handshake or an email without the required terms may still be a contract, but it will not protect the DJ.

Why a US-centric quote template fails Ontario deposits

The site's quote template is US-centric. It may assume the contractor status defined by the IRS independent contractor page, which is a federal US test. Ontario does not use that test for consumer contracts. A US template may also ask for a Form W-9, which is an IRS form for US payers. A Canadian client will not have a W-9, and a Canadian DJ does not need one. These details are easy to overlook when the deposit and cancellation section is copied from an American contract. The result is a contract that looks professional but misses Ontario cancellation rights.

What happens if you skip it

A DJ who accepts a deposit without the required written terms gives the client a one-year cancellation right. For a wedding booked in Ontario, the client can cancel the next day after signing and demand a full refund if the contract lacks the total price, date, or cancellation rights. The DJ may also face a complaint to Consumer Protection Ontario. If the office finds an unfair practice, it can issue compliance orders or refer the matter for prosecution. In British Columbia, a consumer can cancel a future performance contract if the supplier does not provide a copy within 15 days. The deposit must then be returned. This is a concrete business risk, not a theoretical one. A setup fee dispute can trigger the same one-year window. See Charge a DJ Setup Fee for the difference.

Common questions

Does Ontario have a cooling-off period for DJ contracts? Ontario's 10-day cooling-off period applies to direct agreements such as door-to-door sales, not typically to a DJ booked online or at a venue. If the contract is a future performance agreement, the one-year cancellation for missing information is the stronger tool. Can a DJ keep a deposit if the client cancels? Only if the contract says what happens on cancellation and the term is not unfair under the provincial act. A blanket non-refundable clause is often void. Which province's law applies to a Toronto event with a Vancouver client? The event location in Ontario usually determines that Ontario's Consumer Protection Act applies, but contract terms can state a choice of law. Courts may still apply the consumer's home province if it offers stronger protection. What records should a DJ keep after a cancellation dispute? Keep the signed contract, deposit receipt, all messages about the cancellation, and proof of any refund or refusal.
